Jane Street Global Privacy Notice

APPLICABILITY.

This Notice describes how Jane Street treats personal information we may collect from you in the context of your relationship with Jane Street, including on www.janestreet.com and other websites and mobile applications managed by Jane Street that incorporate this Notice (“Platforms”).

WHAT INFORMATION WE COLLECT.

The types of information we may obtain include:

  • personal and contact details, such as your name, signature, telephone number, and postal and email address;
  • demographic information, such as your race/ethnicity, age, gender, gender identity, nationality or citizenship status;
  • government-issued identification information, such as your Social Security number, passport number, driver’s license number, or similar identifier (in connection with our compliance with anti- money laundering requirements);
  • financial account information (such as of our subcontractors and vendors, or in connection with our compliance with anti- money laundering requirements);
  • audio and visual information, such as photographs, video images, or call recordings (such as if you visit or call one of our offices);
  • location information;
  • login information for our Platforms where applicable, such as email address and password;
  • information about your use of our offerings, such as if you play one of the games operated by Jane Street (including Figgie) or submit a solution on our puzzles page;
  • information we may obtain when you attend one of our events or apply for one of our scholarship programs, such as information about your education history;
  • commercial information, such as products or services obtained or considered (such as in connection with travel arrangements or expense reimbursements if you are selected to attend one of our qualifying programs);
  • social media information; and
  • any other information you choose to provide to Jane Street.

As required by law, we will obtain your consent before collecting, using, or disclosing your information and notify you of the purposes of such use at or before the time of collection.

We may also collect information about the browser and computer you use to access our Platforms. This might include your IP address. We may use third-party analytics services on our Platforms to disclose or collect information, such as Google Analytics. HOW WE USE INFORMATION.

We may use information we obtain for the following legitimate business purposes:

  • communicating with you and processing inquiries and complaints;
  • enabling you to participate in our events;
  • establishing and managing our business relationships;
  • operating, evaluating, and improving our business (including administering the Platforms; troubleshooting technical issues; developing new, and enhancing and analyzing our offerings; managing our communications; performing data analytics; and performing accounting, auditing and other internal functions);
  • maintaining and enhancing the safety and security of our Platforms, offerings and preventing misuse;
  • verifying your identity and preventing fraud and other criminal activity, claims and other liabilities, including performing anti- money laundering due diligence activities;
  • exercising our rights and remedies, responding to requests from government entities, and defending against legal claims; and
  • complying with and enforcing applicable industry standards and Jane Street policies.

Subject to applicable law, we use information for these purposes based on your consent or because we have a legitimate business interest. We also may process information where it is necessary to comply with our legal requirements and regulatory obligations.

Where we have a contract with you, we process information as necessary to perform our contractual relationship with you, provide our offerings, and manage our relationships. We may also use information in other ways for which we provide specific notice at the time of collection.

WE MAY SHARE INFORMATION WITH THIRD PARTIES.

We may share information within the Jane Street family of companies and with third parties for purposes described in this Notice and in accordance with applicable law. Such third parties include (1) service providers including internet service providers, operating systems and platforms, and IT support vendors; (2) professional services organizations, such as auditors and law firms; (3) our customers, and business partners; and (4) social media platforms if you use those services to connect with us.

We also may disclose information (1) if we are required to do so by law or legal process, such as a court order, regulatory reporting requirement or subpoena, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities; (2) in response to requests by government agencies, such as law enforcement authorities; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; (6) in connection with a potential or actual sale or transfer of all or a portion of our business or assets (e.g., in the event of an acquisition, merger, reorganization, dissolution or liquidation); or (7) otherwise with your consent or as directed by your representative.

WE COLLECT AND STORE INFORMATION BOTH IN AND OUTSIDE OF THE UNITED STATES.

Information that we collect from you may be transferred to and stored within countries other than the country in which information originally was collected in accordance with applicable law. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer information to recipients in other countries, we will protect that information as described in this Notice.

Where we transfer information outside of jurisdictions subject to data transfer restrictions, we will put in place appropriate safeguards.

Where we transfer information outside of Switzerland, the UK, the European Economic Area (“EEA”), to the extent these data recipients are in countries that are not recognized as providing an adequate level of data protection, we provide appropriate safeguards aimed at ensuring a required level of data protection, including by entering into Standard Contractual Clauses issued by relevant authorities, such as the European Commission.

If we transfer your personal data outside Singapore, we will ensure that the recipient is bound by legally enforceable obligations to provide a standard of protection that is at least comparable to the protection under the Singapore Personal Data Protection Act 2012. HOW LONG WE RETAIN INFORMATION.

We will retain your personal information for the period reasonably necessary to achieve the purposes set out in this Privacy Notice (or any other notice provided at the time of collection) and our legal obligations, taking into account applicable statutes of limitation and records retention requirements under applicable law.

You have certain choices in connection with information we obtain. You can tell us at any time not to send you marketing communications by following the instructions in those email messages. You also may ask us not to contact you in connection with any update, news, or event by contacting us as described below.

Subject to applicable law, and depending on your jurisdiction of residence, you also may have the right to:

  • request confirmation of whether we process information about you;
  • request that we rectify, correct, amend or update information that is inaccurate, incomplete or outdated;
  • request the identities of other entities with whom information has been shared;
  • nominate another individual to exercise your rights in the event of your death or incapacity;
  • request that we delete/erase information in certain circumstances;
  • request that we restrict the use of information in certain circumstances, such as while we consider another request that you have submitted like a request that we update information;
  • object to our processing of information on grounds relating to your particular situation;
  • where you have given us consent to process information, withdraw your consent (subject to applicable legal and contractual restrictions and reasonable notice subject to applicable law); and
  • request that we provide a copy of information to you in a structured, commonly used and machine readable technological format in certain circumstances.

Our Platforms are meant for adults. We do not knowingly solicit, collect, use or disclose information from children under the age of 16 (or other minimum age as specified under applicable law). If you believe a child under age 16 (or other applicable age in your jurisdiction) may have provided us with information without parental consent, please contact us as specified in the contact section of this Notice.

If you click on some links on our Platforms, you will be taken to websites we do not control. This Notice does not apply to the privacy practices of those websites. We are not responsible for these third-party sites or services.

WHAT WE WILL DO IF THERE IS AN UPDATE TO THIS NOTICE.

From time to time we may update this Notice to reflect changes in our privacy practices. We will notify you of material changes to this Notice as required by law. We will also post an updated copy on our website and indicate at the top of the Notice when it was most recently updated. Please check our site periodically for updates.
